EARLY DISPUTE
RESOLUTION

Tatevik is a skilled mediator trained in Early Dispute Resolution ("EDR") through EDR Institute ("EDRI") and American Arbitration Association ("AAA"). EDR is an expedited, cost-effective, voluntary dispute resolution process that parties engage in before significant discovery or motion practice.  It is structured to be completed in as little as 30 days.  It is grounded in the reality that most cases settle – less than 5% actually go to trial – and that engaging in a prolonged, adversarial process prior to settling isn’t necessary.  Instead, the parties can undertake EDR in the earliest stages of their dispute and a achieve a fair resolution.

EDR is not traditional mediation where a mediator is chosen, usually after the parties are months in to litigation or arbitration, and settlement hinges on the parties’ one-day session in which they try to resolve the dispute.  EDR addresses the problem of the parties not having all of the relevant information they need to meaningfully evaluate their potential liability.  They may not have analyzed the likelihood of various outcomes at trial or in arbitration.  And they may not have a clear idea of the costs they will incur to go through the litigation or arbitration process.

EDR is confidential and subject to the same privileges as those that apply in litigation or arbitration.  The EDR process starts with either an agreement between the parties to engage in EDR, a court-mandated referral to EDR or a contractual provision where the parties have previously agreed that they will use EDR in the event of a dispute.

EDRI has developed a robust process to overcome the shortcomings many parties experience when they mediate.  Like mediation, it is voluntary and involves the parties’ negotiating in an effort to resolve their dispute.  Unlike mediation, it is structured to give the parties’ an informed view of the relevant facts and law and a clearer view of what the range of settlement values is.  The process is set out in the Protocols established by the EDRI and available here.  The Protocols are intended to be applied flexibly; the EDR process is adaptable to fit the parties’ dispute.
